JOHN M. MINAR, sworn for the Defendant.

I am a newspaper reporter for the "Atlanta Georgian. "

I visited George Epps Sunday night, April 27th.

I went there to ask him and his sister when was the last time either of them had seen Mary Phagan.

George Epps and sister were both present.

I asked them who had seen Mary Phagan last, and the little girl Epps said she had seen her on the previous Thursday.

George Epps was standing right there and he said nothing about having seen her Thursday.

He said he knew the girl, that he had ridden to town with her in the mornings occasionally when she went to work.

He said nothing as to having seen the girl on Saturday and coming in on the car with her.

I directed my questions to both the children.

CROSS EXAMINATION.

I was not seeking evidence for the defendant.

There was no defendant at that time.

This was on Sunday, the day the body was found.

I have been working under the direction of Mr. Clofein, city editor.

Clofein visited Frank in jail.

At that time Mr. Frank had not been mentioned in connection with the case at all.

At the time of the interview with the little girl and the little boy they were both in the room with their father.

Their father took me out there.
