Hearing for New Trial Set for Saturday. Dorsey May Ask for More Time.

Announcement was made Tuesday by Attorney L. Z. Rosser,

for Leo M. Frank, sentenced to hang October 10, for the murder of

Mary Phagan, that the papers in the plea for a new trial would be

served today upon Solicitor General Hugh M. Dorsey. The hearing

is set for Saturday and it is not known until the solicitor sees the

plea whether he will be in a position to answer it on the date set.

The defense has worked on its case and those who know

something of the preparation declare that much has been brought

out to show that a new trial should be granted the condemned

man. The case is due to be heard, before Judge L. S> Roan, who

presided at the trial. In case of a postponement it is probable that

Judge Roan, who is soon to take his place on the court of appeals

bench, will stay long enough to preside at the hearing, as he is

well acquainted with all details and the other superior court

judges believe he is the logical man to hear the case.
